Cancellation policy
GENERAL RENTAL TERMS AND CONDITIONS (GRTC)
- Purpose and Acceptance
These General Rental Terms and Conditions (GRTC) apply to all short-term furnished rental bookings made via casaluciano.fr. Any booking implies the tenant’s full and unconditional acceptance of these GRTC. Payment constitutes acceptance of these GRTC without reservation. - Booking and Confirmation
The booking is considered final upon receipt of full payment. For online bookings, the tenant has a 14-day right of withdrawal (unless the stay begins within 14 days). - Rates and Payment Terms
Rates are indicated in euros (€) and include the rental, cleaning fees, tourist tax, and bed linen and towels for the exact number of occupants specified in the booking.
Accepted payment methods: credit card and Bancontact (via Stripe). - Cancellation and Modification
- Cancellation by the tenant:
- More than 5 days before arrival: refund of payment (excluding 5% administrative and banking fees).
- Less than 5 days before arrival: no refund.
- For arrivals on Saturday, free cancellation is possible before the preceding Monday at 16:00.
- Cancellation by the owner: In case of cancellation, the owner will fully refund all amounts paid and, if possible, offer an alternative solution.
- Booking modification: Any change (dates, number of people) is subject to approval and may incur additional charges based on the daily rate for the new dates requested, subject to availability and the number of people. No modifications will be possible less than 5 days before arrival.
- Inventory of Fixtures
The tenant must report any damage noticed upon arrival before 11:00 PM on the day of arrival; otherwise, the tenant acknowledges the property is in good condition by default. If damage is found after the tenant’s departure, the owner may seek compensation or take legal action if no amicable agreement or mediation is reached. - Tenant’s Obligations
The tenant agrees to:
- Respect the property, equipment, and neighbors.
- Not organize unauthorized parties or events.
- Not exceed the maximum number of occupants specified.
- Immediately inform the owner in case of any issues (breakdowns, damages).
- Owner’s Obligations
The owner agrees to:
- Provide a clean property that matches the description.
- Ensure peaceful enjoyment of the property during the stay.
- Insurance
The owner declares having taken out PNO (Non-Occupied Property) insurance. The tenant is advised to check that their civil liability insurance covers any potential damage caused during the stay. In the absence of insurance, the tenant will be fully responsible for any costs incurred. - Disputes
Any dispute will first be attempted to be resolved amicably. If unsuccessful, the Dunkirk court will have jurisdiction. - Personal Data Protection
The tenant’s personal data is collected for rental purposes and will not be retained for more than 6 months after the stay, in accordance with GDPR. - Miscellaneous Clauses
- A. Pets: Although we appreciate their company, pets are not allowed. The tenant must comply with hygiene rules.
- B. Smoking: Smoking inside the property is strictly prohibited. Failure to comply will result in an additional €100 cleaning fee for odor removal.
- C. Neighborhood Rules: Parties are strictly prohibited in the co-ownership, and noise disturbances are prohibited between 10:00 PM and 8:00 AM. Any violation may result in immediate eviction without refund. The residence has 24/7 security connected directly to the competent authorities.
- D. Household Linen: Household linen (sheets, towels) is provided. In case of loss or damage, replacement fees will be charged.
- E. End-of-Stay Cleaning: The property must be left in a clean state, with dishes washed and put away, and waste disposed of in the appropriate bins. Failure to comply will result in additional charges.
- F. Parking: Paid parking is available in the residence for €10 per day. The owner declines all responsibility in case of theft or damage to the vehicle. In the event of an incident involving the tenant or an occupant’s vehicle, the responsible party’s insurance will cover any claims.
- G. Wi-Fi: Wi-Fi access is provided free of charge. The owner does not guarantee uninterrupted connection and declines all responsibility in case of outages.
- H. Valuables: The owner declines all responsibility in case of theft or loss of valuables left in the property.
- Applicable Law
These GRTC are governed by French law.
